Although Coloradans can be cited for not properly securing their guns, or fined for not reporting a gun theft, there is no state law that would expose a gun owner to criminal charges solely because their gun is used in a crime after being stolen from them.

When firearms are not in use, Colorado law requires that they be stored in a locked gun safe, secured with a trigger lock or otherwise made inaccessible to children and others. Failure to do so is a misdemeanor punishable by a fine and up to 120 days in jail.

In 2021, Colorado’s Senate Bill 78 made it state law to report a stolen or lost firearm within five days. Following the rule protects against prosecution for unsafe storage. A first offense is a civil infraction with a $25 fine. A repeat offense is a misdemeanor punishable by up to a $500 fine.
